Contractual Considerations
Certificate of Insurance Requirements
All exhibiting companies must provide proof of insurance
with their Application for Exhibit Space. Companies
will not be allowed to exhibit without proof of insurance.
The CDG requires the following coverage:
- Comprehensive General Liability
insurance, including contractual liability with limits
of at least $1,000,000 personal injury of each occurrence
and $500,000 property damage for each occurrence
- Workman's Compensation to full compliance
of federal and state laws covering all of Exhibitor's
employees engaged in performance of any work for the
Exhibitor
- Employer's Liability with a limit
of at least $100,000
Your insurance carrier will be familiar with our request
for "Certificate of Insurance." Please include
the Certificate of Insurance with the Application for
Exhibit Space.
Insurance
Each party involved in the 2000 CDMA Americas Congress,
i.e., hotel, owners and Exhibitors, agrees to be responsible
for any claims rising out of its own negligence or that
of its employees or agents.
Each party agrees to be responsible
for its own property through insurance or self-insurance
and shall hold harmless each of the other parties for
any and all damage caused by theft and those perils
normally covered by fire and extended coverage policy.
Liability
It is understood that the CDMA Development Group (CDG),
the Sheraton Harbor Island, Thomas Hannah & Associates
(THA, Inc.) and their agents shall have no liability
for injury to any person or for any loss of, or damage
to, goods or property of Exhibitors prior to, subsequent
to, or during the time of the exhibit set-up and/or
tear-down, and that the Exhibitor expressly releases
the CDG, THA, the Sheraton Harbor Island, and their
agents from every such liability, and agrees to indemnify
them against all claims which may be caused or contributed
to by the Exhibitor or any person acting on behalf of,
or otherwise representing, the Exhibitor.
The CDG shall not be liable for damages
from its failure to provide, or delay in providing,
exhibit space because of fires, floods, strikes, riots,
acts of war or insurrection, accidents, lockouts, close
down of exhibit facilities, Acts of God, or any circumstances
or other unavoidable causes beyond the CDG's control.
Residual Matters
All matters not expressly covered in the rules and regulations
of the Sponsor & Exhibitor Prospectus will be subject
solely to the decision of the CDG.
